By accessing, browsing, or utilizing the services provided on AutoInsure.online ("the Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any portion of these Terms, you must discontinue use of the Site immediately.
2. Non-Broker & Non-Underwriter Disclosure
AutoInsure.online is an independent advertising comparison portal and is NOT an insurance agency, licensed insurance broker, or insurance underwriter.
We do not underwrite, sell, issue, or bind insurance policies. Submitting a ZIP code or inquiry through our website transmits your information to certified third-party insurance companies, partner aggregator networks, or licensed agents who are solely responsible for calculating your final binding policy rate.
Quotes, rates, and coverage examples shown on this site are general estimations for illustrative comparison purposes only. Final premium terms, discounts, and coverage availability are determined exclusively by third-party carriers based on individual driving histories, credit-based insurance scores (where permitted by state law), garaging address, vehicle telematics, and underwriting criteria.
3. Eligibility & User Conduct
To use this Site, you represent and warrant that:
- You are at least 18 years of age and legally capable of entering into binding contracts.
- All information you submit (including ZIP code and contact details) is truthful and accurate.
- You will not use automated scrapers, web spiders, data mining scripts, or robotic tools to extract proprietary state rate databases or carrier comparison metrics without prior written consent.
- You will not interfere with or disrupt the security or integrity of our Apache servers or network connections.
4. Mandatory Binding Arbitration & Class Action Waiver
Please review this section carefully. It substantially affects your legal rights, including your right to file a lawsuit in court.
A. Informal Dispute Resolution: Before initiating arbitration, both you and AutoInsure.online agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to this Site informally by contacting legal@autoinsure.online.
B. Binding Arbitration: If the dispute is not resolved within sixty (60) calendar days, any controversy or claim will be settled exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of general jurisdiction.
C. Class Action Waiver: YOU AND AutoInsure.online AGREE THAT ANY CLAIMS SHALL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
D. Waiver of Jury Trial: You and AutoInsure.online knowingly and voluntarily waive any constitutional or statutory right to a trial by jury.
5. Limitation of Liability & Disclaimer of Warranties
The Site and all content, materials, calculators, and rate estimates are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
In no event shall AutoInsure.online, its directors, officers, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to, use of, or inability to access the Site or insurance quotes obtained through third parties.
6. Governing Law & Severability
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be deemed severable and shall not affect the validity of remaining provisions.
